We are committed to giving you transparency of our privacy practices and control over your data in connection with HST’s Services (as defined in HST’s Terms of Service). This Privacy Policy is part of HST’s Terms of Service and covers the treatment of project information, including technical and financial information, obtained by HST, including information obtained when you use the Application (as defined in HST’s Terms of Service) or the Services provided by HST. We may change this Privacy Policy from time to time. We encourage you to review the Privacy Policy whenever you access the Services to stay informed about our information practices and the ways you can help protect your privacy.
Collection of Information
Information You Provide to Us: When you register for any HST Services or Application we ask for information such as your name, company name, email address, billing address, credit card or checking account information. HST uses collected information for the following general purposes: provision of products and services provision, billing, identification and authentication, services improvement, contact, and research. HST does not share your personal information with third parties, unless explicitly approved by you.
To add users to your account, you will have to provide us with Personal Information about such users, including their name and email addresses. If you are adding users to your account, then you represent and warrant you have the right to provide those users’ Personal Information to us. We also collect information when you use the Services, including technical and commercial information, milestones and status of your solar photovoltaic power projects. We receive and store any information you enter on our Services or provide to us in any other way. Information submitted to the Application may also be used to: enable our compliance with applicable laws and regulations, enable your use of the Application and associated Services, provide you with an up to date, efficient and reliable service, provide you with most relevant solar energy systems and best-in-class investment returns; and generally run and improve the Application. Information Collected Automatically: When you use the Services, HST automatically receives and records usage, log, device, and location information on our server logs from your browser or mobile platform, including your location, IP address, browser type, operating information, device and application IDs, cookie information, and the page you requested. We treat this data as non-Personal Information, except where we are required to do otherwise under applicable law. Unless otherwise stated in this Privacy Policy, HST only uses this data in aggregate form. Information We Receive from Third Parties: We receive and store information from Third Parties that interact in some way with the Services or that provide services to us in connection with the Services. We may also receive information from other sources and combine that with information we collect through our Services.
Cookies and Usage Analysis
We use ‘cookies’ and similar technologies on the Application (“Cookies”). Cookies are required to use the HST Services. Cookies are small computer files that the Application may store in your Internet browser, enabling your Internet browser and the Application to communicate with each other. Other similar technologies may operate in a different way but, like Cookies, are used to analyze how the Application is being used. Cookies enable us to record anonymous information about you, including: the type of Internet browser you use to access the Service, your computer operating system, the websites you visited before accessing the Application, the areas of the Application you visit, how long you visit the Application and your IP address. We do not use Cookies to determine your individual identity. Some Cookies will be deleted when you close the Application or your Internet browser, others will remain on the Application or your Internet browser until they are deleted or they reach their expiry date. Most browsers allow you to block and delete cookies. However, if you do that, the Services may not work properly. By using the Services, you are authorizing us to gather, parse, and retain data related to the provision of the Services.
Use of Information
We may use information about you for various purposes, including to: Provide, maintain and improve our Services, including to provide additional features and content for your solar energy projects; Provide and deliver the services you request, process transactions and send you related information; Respond to your comments, questions and requests and provide customer service; Personalize and improve the Services, content or features that match customer or project profiles; Link or combine with information we get from others to help understand your needs and provide you with better service; Detect, investigate and/or prevent fraudulent, unauthorized or illegal activity; and Carry out any other purpose for which the information was collected. We may anonymize and aggregate data collected through the Services and use it for any purpose. Non-public, but non-personally identifiable information, regarding HST’s current and potential clients, including but not limited to geographic, or aggregated client information, can be used by HST for any purpose. We may share any information we receive with vendors and service providers retained in connection with the provision of the Services. HST and certain third-party service providers may use personal nonpublic information for reasons that include but are not limited to: account opening and validation; to comply with federal, state and local statutes; to process design and engineering services; to send information to clients and client-related parties; to improve HST services; to protect the security and integrity of our businesses, properties, affiliates, and clients; and to respond to legitimate and legal requests from governmental authorities or in connection with other legal proceedings. Third-party service providers may include, but are not limited to, financial institutions, utilities and power producers, corporations and small businesses, component manufacturers, and contractors charities. Such sharing may not be limited.
We may share your information with third parties with whom you choose to let us share information, and with your colleagues (or similar entity) and any necessary third parties engaged by us or your employer.
HST is based in the United States and the information we collect is governed by U.S. law. By accessing or using the Services or otherwise providing information to us, you consent to the processing and transfer of information in and to the U.S. and other countries.
In the Event of Merger, Sale, or Bankruptcy: In the event that HST is acquired by or merged with a third party entity, we reserve the right to transfer or assign the information we have collected from our users as part of such merger, acquisition, sale, or other change of control. In the (hopefully) unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors’ rights generally, we may not be able to control how your personal information is treated, transferred, or used.
As Required By Law and Similar Disclosures
We may access, preserve, and disclose your Personal Information, other account information, and content if we believe doing so is required or appropriate to: comply with law enforcement requests and legal process, such as a court order or subpoena; respond to your requests; or protect yours’, ours’ or others’ rights, property, or safety.
Our Commitment To Data Security
HST uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run our services. Although HST owns the code, databases, and all rights to the Applications, you retain all rights to your data. HST uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your information. We cannot, however, ensure or warrant the security of any information you transmit to HST and you do so at your own risk. Once we receive your transmission of information, HST makes commercially reasonable efforts to ensure the security of our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. Your use of the HST Application and Services acknowledges that HST is not liable or responsible for any intercepted information and you hereby release HST from any and all claims arising out of or related to an unauthorized or inadvertent breach of data or violation of privacy policies.
International Users
If you are a user accessing the HST Applications and Services from the European Union, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from United States laws, please be advised that through your continued use of the HST Application and Services, which are governed by California law, this Privacy Policy, and our Terms of Service, you are transferring your personal information to the United States and you expressly consent to that transfer and consent to be governed by California law for these purposes.
Changes
We may change this Privacy Policy from time to time. If we make significant changes in the way we treat your personal information, or to the Privacy Policy, we will provide you notice through the Services or by some other means, such as email. Your continued use of the Services after such notice constitutes your consent to the changes.
